Terms of Service

1. The Service

These Terms of Service ("Terms") govern your use of Gift Swap Central (the "Service"), operated by Gift Swap Central ("we," "us" or "our"). By creating an account, joining an event or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

Gift Swap Central helps groups run gift exchanges: drawing names for Secret Santa, sharing wish lists, and playing white elephant and similar games live.

2. Accounts

Organizers create an account. Participants sign in with an email link or Google. You must give accurate information and keep it current, and you're responsible for activity under your account.

Organizer accounts are for adults (18 or older, or the age of majority where you live). A participant under 18 may join an event only with a parent or guardian's permission.

3. Events and organizers

An organizer creates an event, invites participants, sets its rules and runs the draw or the swap. Organizers are responsible for who they invite and for the event's rules, such as price limits and how gifts are delivered.

Gifts are bought, wrapped, delivered and exchanged by participants, not by us. We aren't a party to any gift, purchase or delivery between participants.

4. Party passes and payments

Some events are free. Others need a one-time party pass, paid by the organizer at the price shown before purchase. A party pass covers one event and is not a subscription.

Payments are handled by our payment provider. Unless the law requires otherwise, a party pass can't be refunded once the event's names have been drawn or its swap has started.

5. Acceptable use

You agree not to use the Service to:

• Harass, threaten, bully or defame anyone.
• Post wish list items, messages or images that are unlawful, hateful, sexual or that infringe someone else's rights.
• Impersonate any person or misrepresent your affiliation.
• Send spam, or invite people who haven't agreed to hear from you.
• Bypass, probe or disrupt the Service's security or infrastructure.
• Scrape, resell or sublicense the Service without our written permission.

6. Your content

You keep ownership of what you add, such as wish lists, messages and photos. You give us a limited license to store, process and show that content to the people in your events, as needed to run the Service. We may remove content or suspend accounts that break these Terms.

7. Gift guide and affiliate links

Our gift guide and some gift ideas include affiliate links. If you buy through one, we may earn a commission at no extra cost to you. Products bought from other stores are sold by those stores, under their terms.

8. Our intellectual property

The Service, including its software, design, mascot and branding, belongs to us and our licensors. We give you a limited, non-exclusive, non-transferable license to use it while you follow these Terms.

9. Availability and changes

We work to keep the Service running, but we don't guarantee it will always be available or error-free. We may change, suspend or stop any part of it, with reasonable notice when we can.

10. Ending your use

You can stop using the Service at any time. To close your account and delete its data, email support@giftswapcentral.com. We may suspend or close accounts that break these Terms, when the law requires it, or to protect other people using the Service.

11. Disclaimer of warranties

The Service is provided "as is" and "as available," without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the fullest extent the law allows, our total liability for any claim about the Service is limited to the greater of the amount you paid us in the twelve months before the claim, or US$100. We aren't liable for indirect, incidental, consequential or punitive damages, or for gifts, purchases or deliveries between participants.

13. Indemnification

You agree to defend and indemnify us against third-party claims arising from your use of the Service, your content or your breaking these Terms.

14. Changes to these Terms

We may update these Terms. If a change is material, we'll tell you by email or in the Service before it takes effect. Using the Service after that means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of California, USA, without regard to conflict-of-law rules. Disputes go to the courts of California, unless consumer law where you live says otherwise.
